Customized Single Purpose By-Laws

Under the Condominium Act, condominium corporations can have an array of powers that can make managing the property significantly easier. However, sometimes the Act requires that the corporation put a by-law in place before those powers are available. Such by-laws are known as single-purpose by-laws that can be customized to suit the corporation’s individual needs.

At GMA, we can help your corporation enact such a customized single-purpose by-law for granting powers like:

  • Property Assessments – The corporation can object to Assessment Act (Ontario) property tax assessments on behalf of owners.
  • Insurance Deductible Chargeback – This by-law extends the circumstances where an owner becomes responsible to pay the greater of the insurance deductible amount or the cost of damage that such owner causes.
  • Occupancy Standards – Occupancy standards to prohibit excess persons from occupying residential units are established. Uses of residential units for commercial or other purposes are prohibited (but an ancillary home-office is permitted).
  • Safety Devices – The board has discretion to fund installation and repair of various types of "safety devices".
  • Mediation and Arbitration – Procedures streamline mediation/arbitration of disputes.
  • Borrowing – The corporation is empowered to borrow significant funds listed in the current year’s budget.
  • Insurance Trust Agreement – The board will be empowered to terminate the existing Insurance Trust Agreement, but is required to enter into an Insurance Trust Agreement in an event of damage whereby proceeds in excess of 15% of the replacement costs of the insured property become payable by the insurer.
  • Telecommunications – Inherent easement powers are granted to the board to permit telecommunications access and bulk service agreements, installation of service utilities and ancillary servicing equipment.
  • Leases and Licences – Leases negotiated by the board pertaining to superintendent suites, guest suites, laundry facilities and party room rentals are automatically approved by by-law according to provisions at the board’s discretion.
