New Homes and Condominiums

Toronto Real Estate Lawyers - Art by David Crighton

All across Ontario, we are seeing a wave of new houses and residential condominiums being built. But it is surprising how many people buy a new home without a clear understanding of their rights and obligations. Are you in the market for a brand new house or condominium? If so, good legal advice can be very useful and GMA can help.

Buying a New Home
We know that the legal intricacies of buying a new house can be confusing, and the whole process can sometimes be expensive and time consuming. Especially when trying to wade through the agreements of purchase and sale that builders sometimes present. On your own, it can be difficult to know whether the house you actually get is the same as the one you wanted to buy complete with all the cabinetry, flooring, lighting and other features that you initially ordered.

This is where GMA can help. We can review your agreement of purchase and sale and help you work though problems with builder, arrange the title transfer and provide advice that can maximize your chances of getting from your builder the home you initially wanted. We can also assist you with claims under the Ontario New Home Warranty Program if any. If you are looking for assistance contact a GMA lawyer.

The Newly Built Condominium
Among Ontarians there is a keen interest for new condos particularly among younger buyers just entering their careers and older people nearing retirement. For a number of Ontarians, condominium living is becoming the preferred lifestyle choice.

When buying a newly built condominium unit, the potential buyer is at a disadvantage. Builders regularly use high-pressure sales tactics that can catch a new buyer off-guard. The Condominium Act (Ontario) has provisions to protect consumers who find themselves in these circumstances. At GMA, we are condominium law specialists – i.e. CondolawyersTM – that can assist with many issues, including the following:

  • Review the Agreement of Purchase and Sale and Disclosure Statement;
  • Advice on the 10-Day Cooling Off Period;
  • Advice on the Occupancy Period prior to registration of the condominium; and
  • Pre-delivery inspection and compensation from the Ontario New Home Warranty Program.
